Client Terms & Conditions
Introduction
These Client Terms & Conditions set out the relationship between Excellence Yacht Agency ("the Agency") and any yacht, owner, management company or representative ("the Client") engaging the Agency to source crew.
Scope of Services
The Agency provides crew-sourcing and introduction services. Candidates are carefully assessed through structured interviews, verification of qualifications and reference checks before introduction.
Engagement of Candidates
An introduction is deemed to have been made when the Agency provides Candidate details to the Client. Should the Client engage a Candidate introduced by the Agency, the relevant placement fee becomes payable in accordance with the fee schedule agreed in writing.
Fees & Payment
Placement fees are agreed in advance and confirmed in writing. Invoices are payable within the agreed period from the date of engagement.
Replacement Policy
Where a placed Candidate leaves or is found to be unsuitable within the agreed guarantee period, the Agency will endeavour to source a suitable replacement in accordance with the terms agreed at the point of placement.
Confidentiality
Both parties agree to treat commercially sensitive information shared during the engagement as confidential.
Liability
The Agency takes reasonable care in assessing Candidates but does not guarantee the performance or conduct of any Candidate once engaged. The Client remains responsible for its own due diligence and onboard verification.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of England & Wales.
